Rolex Config (the "Site") is an independent, non-commercial editorial fan publication and reference tool for enthusiasts of Rolex timepieces. This page explains what the Site is, what it is not, and the legal posture under which it operates.
1. Independent and Unaffiliated
Rolex Config is not affiliated with, endorsed by, sponsored by, or connected to Rolex SA, Rolex Watch U.S.A., Inc., or any of their subsidiaries, affiliates, or authorized dealers in any way. All references to Rolex, to specific Rolex model names (including but not limited to Datejust, Day-Date, Submariner, Cosmograph Daytona, GMT-Master II, Explorer, Sea-Dweller, Deepsea, Yacht-Master, Sky-Dweller, Air-King, Oyster Perpetual, Lady-Datejust, 1908, and Land-Dweller), to reference numbers, and to related terms such as Oyster, Oysterflex, Jubilee, President, Cerachrom, Oystersteel, and Superlative Chronometer are used nominatively — that is, solely to identify the products being discussed. The Rolex name and the Rolex crown device are registered trademarks of Rolex SA. All such trademarks remain the exclusive property of their respective owners.
2. Editorial Purpose
Rolex Config exists to serve collectors, enthusiasts, and prospective buyers with a faster, more navigable reference to the current Rolex catalog than is otherwise available. Its purposes are:
These purposes are editorial in nature and non-commercial.
3. Fair Use Statement
Certain images, reference numbers, factual specifications, and retail prices displayed on the Site may be drawn from publicly available Rolex materials. Any such use is made in good faith reliance on the doctrine of fair use as codified in Section 107 of the United States Copyright Act (17 U.S.C. § 107) and on the doctrine of nominative fair use in trademark law as recognized in New Kids on the Block v. News America Publishing, Inc., 971 F.2d 302 (9th Cir. 1992).
The four-factor fair use analysis supports this use as follows:
1. Purpose and character. The use is non-commercial, editorial, and transformative. Images and specifications are presented alongside original commentary, organized into an original reference structure, and used to identify, inform, and educate — not to sell watches or compete with Rolex's own marketing channels.
2. Nature of the work. The materials referenced are factual product information (reference numbers, specifications, prices) and commercial product photography created for marketing purposes, both of which receive thinner copyright protection than creative expressive works.
3. Amount and substantiality. Only the minimum necessary to identify each configuration is used, and imagery is presented at reduced resolution suitable for reference.
4. Market effect. The Site does not substitute for a visit to rolex.com, does not sell watches, does not offer affiliate links to retailers, and does not compete with any Rolex product or service. If anything, the Site drives interested enthusiasts toward Rolex's own channels via direct outbound links to rolex.com on every reference page.
Factual information — including reference numbers, case diameters, materials, movement calibers, water resistance figures, and retail prices — is not subject to copyright protection under Feist Publications, Inc. v. Rural Telephone Service Co., 499 U.S. 340 (1991).
4. No Commercial Activity
Rolex Config does not sell watches, does not broker watches, does not accept payment for placement, does not run advertising, does not participate in affiliate or referral programs, and does not accept compensation of any kind from authorized dealers, grey market dealers, or secondary market platforms. The Site is funded personally by its operator and exists solely as an enthusiast project.
5. Accuracy and Pricing
The Site makes reasonable efforts to keep reference information and retail prices accurate and current, but all information is provided on an as-is basis without warranty of any kind. Retail prices shown reflect publicly listed U.S. retail prices at the time of data collection and may not reflect current prices, regional pricing, taxes, or availability. For authoritative and up-to-date product information, always consult rolex.com or an Authorized Rolex Retailer. The Site is not a substitute for either.
6. Takedown and Contact Policy
Rolex Config respects the intellectual property rights of Rolex SA and all other rights holders. If Rolex SA, Rolex Watch U.S.A., or any rights holder believes that any content on the Site exceeds the bounds of fair use or otherwise infringes a protected right, the operator of the Site will respond promptly and in good faith to any request for removal, clarification, or modification. DMCA takedown notices may be directed to the same address and will be handled in accordance with 17 U.S.C. § 512.
7. Links to Rolex.com
The Site contains outbound links to rolex.com product pages to enable visitors to consult official information and locate Authorized Rolex Retailers. These links are provided for the convenience of visitors. The Site has no control over rolex.com and makes no representation about its content.
8. Visitor Use
Visitors to the Site may browse, reference, and link to Site content for personal, non-commercial use. Visitors may not scrape, reproduce, or redistribute Site content at scale without permission.
9. Changes
These Terms may be updated from time to time. Material changes will be reflected in the "last updated" date below.
10. Governing Law
These Terms are governed by the laws of the State of California, United States.
